The media have published articles stating that Petra Ecclestone and James Stunt have been granted their divorce, having now agreed how their finances will be split.

In fact, the Decree Nisi has been pronounced which does not end the marriage at all. This is the penultimate stage of the divorce but it will be a further 6 weeks until the application for Decree Absolute can be made. It is the pronouncement of the Decree Absolute that ends the marriage.

Media reporting can often be very unhelpful as it provides clients with an unrealistic expectation of the process and, at worst, couples who do not instruct Lawyers simply get it wrong.

Any financial agreement cannot be approved by the Court until the divorce has reached the Decree Nisi stage. In the case of the Ecclestone/Stunt divorce it seems that, therefore, the Decree Nisi has been pronounced and the parties may have applied for an Order by consent to resolve the financial matters.
